Examinations of Working Places in Metal and Nonmetal Mines Final Rule

On October 5, 2017, MSHA will publish a final rule in the Federal Register to stay the effective date of the Examinations of Working Places in Metal and Nonmetal Mines final rule (Exam Rule) from October 2, 2017, to June 2, 2018.

 

The final rule also temporarily reinstates the working place examinations standards that were in effect as of October 1, 2017.
The final rule that was made available on the Office of the Federal Register Public Inspection Desk on October 2, 2017, was withdrawn due to MSHA’s untimely submission to the Federal Register.
This final rule that is available today for public viewing reflects MSHA’s intent to assure that mine operators and miners are provided necessary compliance assistance and training on the requirements of the Exam Rule and to continue protection of metal and nonmetal miners through workplace examinations.
