The Mine Safety and Health Administration (MSHA) has told the National, Stone, Sand & Gravel Association (NSSGA) that it will not issue citations related to the new Workplace Exams Rule until 1 October 2018. This decision will give operators time to understand the rule and allow the agency time to provide additional compliance assistance. MSHA may still issue citations in the case of extremely dangerous hazards
The final rule on Examinations of Working Places in Metal and Nonmetal Mines was published on 9 April 2018 and includes some positive changes proposed by stakeholders from September last year. NSSGA has expressed some concerns relating to certain aspects of the rule but is pleased with the adjusted enforcement schedule.
MSHA is providing an in-person meeting in Seattle on 3 May for stakeholders interested in learning more about the rule. Two further virtual meetings will follow on 10 May and 6 June. More information is available here.
